Acceptance of Terms
By submitting an advertising enquiry, booking advertising space, providing advertising materials, or purchasing advertising with Coffee News Australia, you acknowledge that you have read, understood, and agree to be bound by these Advertiser Terms & Conditions.
These Advertiser Terms & Conditions govern the purchase of advertising with Coffee News (Aust) Pty Ltd (“Coffee News Australia”, “we”, “our”, or “us”).
By booking, purchasing, or submitting advertising for publication with Coffee News Australia, the advertiser (“Advertiser”, “you”, or “your”) agrees to these terms.
These Advertiser Terms & Conditions govern the purchase of advertising with Coffee News (Aust) Pty Ltd (“Coffee News Australia”, “we”, “our”, or “us”).
By booking, purchasing, or submitting advertising for publication with Coffee News Australia, the advertiser (“Advertiser”, “you”, or “your”) agrees to these terms.
1. Advertising Agreement
Advertising placements are subject to acceptance by Coffee News Australia.
We reserve the right to:
Accept or reject any advertisement
Request changes to advertising content
Refuse advertising that is misleading, unlawful, offensive, or inappropriate
Submission of advertising material constitutes confirmation that the Advertiser has the right to publish all content included in the advertisement.
2. Advertising Content Responsibility
The Advertiser is solely responsible for the accuracy, legality, and compliance of all advertising content.
The Advertiser warrants that their advertisement:
Does not infringe copyright, trademarks, or intellectual property rights
Does not contain false, misleading, or deceptive claims
Complies with all applicable Australian laws and regulations
The Advertiser agrees to indemnify Coffee News Australia against any claims arising from the advertisement.
3. Artwork and Submission Deadlines
Advertisers must supply advertising artwork by the required deadline.
If artwork is not supplied by the deadline:
Coffee News Australia may repeat the previous advertisement
Coffee News Australia may create a basic advertisement on the advertiser’s behalf
Publication timing may be affected
Coffee News Australia is not responsible for delays caused by late submission of advertising materials.
4. Advertisement Approval
Advertisers are responsible for reviewing and approving any advertisement proofs prior to publication.
If the Advertiser fails to provide approval within the required timeframe, Coffee News Australia may proceed with publication using the latest approved version.
5. Advertisement Proof Approval
Where advertisement proofs are provided to the Advertiser for review, the Advertiser is responsible for carefully checking all details prior to publication.
This includes, but is not limited to:
Business name
Contact details
Website URLs
Pricing
Offers or promotions
Spelling and grammar
Images and branding
The Advertiser must notify Coffee News Australia of any corrections before the specified approval deadline.
If the Advertiser:
Provides written approval of the advertisement, or
Fails to respond by the approval deadline,
Coffee News Australia may proceed with publication.
Once an advertisement has been approved or published, Coffee News Australia is not responsible for any errors that were present in the approved proof.
Corrections requested after approval may incur additional production costs.
6. Placement of Advertisements
While we make reasonable efforts to accommodate placement requests, specific advertisement placement within a publication cannot be guaranteed unless explicitly agreed in writing.
Coffee News Australia reserves the right to determine final placement.
7. Advertising Results
Coffee News Australia does not guarantee:
Sales
Leads
Customer enquiries
Business growth
Return on investment
Advertising performance may vary depending on market conditions, audience response, and other external factors.
No refunds will be provided based on advertising performance.
8. Advertising Performance Disclaimer
The Advertiser acknowledges that Coffee News Australia provides advertising placement services only.
Coffee News Australia makes no representations or guarantees regarding:
Sales or revenue generated from advertising
Customer enquiries or leads
Return on investment (ROI)
Business growth or profitability
The performance or effectiveness of any advertisement
Advertising results may vary due to factors outside the control of Coffee News Australia, including market conditions, advertiser offers, pricing, reputation, customer demand, and competition.
Any examples, testimonials, or case studies are illustrative only and should not be interpreted as guarantees of performance.
9. Advertiser Responsibility for Advertisement Effectiveness
The Advertiser acknowledges that they are solely responsible for the effectiveness, accuracy, and commercial suitability of their advertisement.
Coffee News Australia may assist with advertisement layout, design, formatting, or wording; however, the Advertiser remains responsible for:
The final content of the advertisement
The accuracy of all information provided
The pricing, offers, and claims made in the advertisement
The suitability of the advertisement for their target audience
Once an advertisement has been approved or published, Coffee News Australia is not liable for claims relating to the effectiveness or performance of the advertisement.
10. Payment Terms
Payment terms will be specified in the advertising agreement or invoice.
Unless otherwise agreed in writing:
Payment is due prior to publication or within the timeframe specified on the invoice.
Coffee News Australia reserves the right to withhold publication of advertisements until payment has been received in full.
All prices are listed in Australian Dollars (AUD) unless otherwise stated.
Invoices not paid by the due date may incur late payment interest at a rate of up to 2% per month, calculated on the outstanding balance until payment is received.
Coffee News Australia reserves the right to require prepayment for all future advertising bookings if invoices are not paid on time.
11. Payment Default
All invoices issued by Coffee News Australia must be paid in accordance with the payment terms specified on the invoice.
If payment is not received by the due date, Coffee News Australia reserves the right to:
Charge interest on overdue amounts at a reasonable commercial rate permitted under Australian law
Suspend or cancel future advertising bookings
Withhold publication of advertisements until payment is received
Require prepayment for future advertising services
The Advertiser agrees that Coffee News Australia may recover reasonable costs associated with collecting overdue amounts, including administrative costs, debt collection fees, and legal expenses where applicable.
12. Cancellation Policy
Advertising bookings may only be cancelled prior to the artwork deadline.
Once advertising production or publication has commenced:
Cancellations may not be permitted
Fees may still apply
Refunds are generally not provided for cancellations after publication deadlines.
13. Non-Cancellation After Production Deadline
Advertising bookings may be cancelled only before the advertisement production deadline specified by Coffee News Australia.
Once the advertisement has entered the production process or the publication has been finalised for printing, the booking is considered confirmed and non-cancellable.
If an Advertiser requests cancellation after the production deadline:
The advertisement fee remains payable in full, and
Coffee News Australia is not obligated to provide refunds or credits.
14. Errors and Omissions
Coffee News Australia will make reasonable efforts to ensure advertisements are published correctly.
However, we are not liable for:
Minor typographical errors
Colour variations
Layout differences
Printing imperfections
In the event of a significant production error caused by Coffee News Australia, our liability is limited to either:
Re-running the advertisement, or
Providing a partial credit for future advertising.
Our liability will not exceed the cost of the advertisement.
15. Limitation of Liability
To the maximum extent permitted by law, Coffee News Australia will not be liable for:
Loss of profits
Loss of business opportunities
Indirect or consequential losses
Advertising performance outcomes
All advertising services are provided without guarantee of commercial results.
16. Indemnity
The Advertiser agrees to indemnify and hold harmless Coffee News Australia, its employees, agents, and affiliates from any claims, damages, liabilities, or legal expenses arising from the publication of the Advertiser’s content.
17. Right of Refusal
Coffee News Australia reserves the right, at its sole discretion, to refuse, reject, cancel, or remove any advertisement at any time.
This includes advertisements that:
Are misleading, deceptive, or unlawful
Contain offensive or defamatory material
Promote illegal products or services
Infringe intellectual property rights
Conflict with the editorial standards or reputation of Coffee News Australia
Coffee News Australia may request modifications to advertisement content before publication.
18. Intellectual Property
The Advertiser grants Coffee News Australia the right to reproduce, publish, and distribute advertisements in:
Print publications
Digital editions
Website listings
Marketing materials relating to Coffee News
Advertisers retain ownership of their trademarks and business branding.
19. Force Majeure
Coffee News Australia shall not be liable for delays or failure to publish advertisements due to circumstances beyond our reasonable control, including:
Natural disasters
Severe weather events
Government restrictions
Pandemics or public health emergencies
Printing or production failures
Distribution disruptions
Power outages or telecommunications failures
Labour disputes
In such circumstances Coffee News Australia may delay, reschedule, or modify publication as necessary.
20. Changes to Advertiser Terms
Coffee News Australia may update these Advertiser Terms & Conditions from time to time.
Updated terms will take effect once published on our website.
21. Governing Law
These Advertiser Terms & Conditions are governed by the laws of Queensland, Australia.
Any disputes arising from advertising agreements will be subject to the jurisdiction of the courts of Queensland.
